[W3C/swf] Problem z walidacja kodu przy flashu, przy zachowaniu przeźroczystości Opcje

Używam poniższego kodu do wyświetlania flasha na stronie. Jest on niestety nie poprawny i nie przechodzi walidacji W3C.
Ma natomiast cechę przez którą nadal go używam - przeźroczyste tło : transparent.
Jaki kod będzie sie poprawnie walidowal z zachowaniem przeźroczystosci pliku swf ?

DZIĘKI mistrzu (IMG:http://forum.php.pl/style_emoticons/default/biggrin.gif) Działa i waliduje poprawnie pod html 4.01 /po usunięciu "/" na koncu /.
Ale pod XHTML wywala błąd :
